SATISFACTION GUARANTEE TO ALL CUSTOMERS.
Customer should contact S.TA.T. if not satisfied with a product for any reason. S.T.A.T. Medical Devices will promptly provide an exchange or refund if the product is returned within 30 days of delivery, in its original packaging and with proof of purchase from S.T.A.T. Medical Devices.
Prices listed do not include freight, handling fees, taxes, and/or duties, and are subject to correction or change without notice. Export orders may be subject to other special pricing. S.T.A.T. reserves the right to accept or reject any order.
Customer agrees that any credit balance(s) issued by S.T.A.T. Medical Devices LLC will be applied to customer’s account within one (1) year of its issuance. IF CUSTOMER HAS NOT REQUESTED THE CREDIT BALANCE WITHING ONE (1) YEAR, ANY REMAINING CREDIT BALANCE WILL BE CANCELLED, AND S.T.A.T. MEDICAL DEVICES LLC SHALL HAVE NO FURTHER LIABILITY.
Orders are usually shipped within 48 hours of receipt. Special items may take longer. Overnight and Special shipping orders will be processed and shipped as soon as possible. If we are temporarily out of stock, items will be back-ordered and shipped upon receipt; times may vary according to availability and any guarantees made as to delivery times are limited to USA and subject to any delays resulting from shipping delays beyond our control, we will not be responsible.
We can ship to virtually any address in the world. Please note that the shipping rates for many items we sell are weight-based. To reflect the policies of the shipping companies we use, all weights will be rounded up to the next full pound.
Please note no returns will be accepted or refunded without a RMA/RGA (Return Goods Authorization) number. You may return items within 30 days of delivery. However, all discrepancies must be reported within 10 days of receiving to be considered a valid returnable order/items. We’ll also pay the return shipping costs if the return is a result of our error (You received an incorrect or defective item, etc.). Items that are not returnable would include the following items: customized items, any sterile product that has been opened, items purchased for resale, items determined not to be in resalable condition.
If you decide you do not want a product that you have purchased from S.T.A.T. Medical Devices LLC, call for a RMA/RGA.
When calling for a return authorization number it is helpful if you have the following information ready:
Write the RGA number on the outside of the box.
Verify instructed return address to send package to is correct.
Enclose a copy of our original invoice/receipt in the box.
You should expect to receive your refund within four weeks of giving your package to the return shipper, however, in many cases you will receive a refund sooner. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process or refund request.
Any products returned may be subject to a restocking fee. Return authorization numbers are valid 30 days after the date they are issued.

LIMITED WARRANTY FOR BUSINESSES
ALL PRODUCTS SOLD ARE WARRANTED BY S.T.A.T. ONLY TO CUSTOMERS FOR (i) RESALE; OR (ii) USE IN BUSINESS, GOVERNMENT OR ORIGINAL EQUIPMENT MANUFACTURE.
S.T.A.T. MEDICAL DEVICES LLC. WARRANTS PRODUCTS AGAINST DEFECTS IN MATERIALS AND WORKMANSHIP UNDER NORMAL USE FOR A PERIOD OF SIX (6) MONTHS AFTER THE DATE OF PURCHASE FROM S.T.A.T. MEDICAL DEVICES, UNLESS OTHERWISE STATED. PROVIDED THAT S.T.A.T. MEDICAL DEVICES ACCEPTS THE PRODUCT FOR RETURN DURING THE LIMITED WARRANTY PERIOD, S.T.A.T. MAY, AT ITS OPTION: (i) REPAIR; (ii) REPLACE; OR (iii) REFUND THE AMOUNT PAID MY CUSTOMER. CUSTOMER MUST RETURN THE PRODUCT TO THE APPROPRIATE S.T.A.T. BRANCH OR AUTHORIZED SERVICE LOCATION, AS DESIGNATED BY S.T.AT. MEDICAL DEVICES, SHIPPING COSTS PREPAID. S.T.A.T. REPAIR, REPLACEMENT, OR REFUND OF AMOUNTS PAID BY CUSTOMER FOR THE PRODUCT, SHALL BE CUSTOMER’S SOLE AND EXCLUSIVE REMEDY.
Customer shall have no right, title, or interest in the trade names, trademarks, copyrights, patents domain names, product names, catalogs or any other intellectual property rights reserved by S.T.A.T. Medical Devices LLC, or any trademarks or service marks owned by suppliers to S.T.A.T. Medical Devices LLC. All materials contained on the website are subject to the ownership rights of S.T.A.T. Medical Devices LLC and its suppliers if any. Customer shall have no right to copy or use any of the intellectual property of S.T.A.T. Medical Devices LLC without S.T.A.T. Medical Devices permission.
Notwithstanding anything in this Agreement to the contrary, the pricing and terms of this Agreement will be proprietary and confidential to S.T.A.T. Medical Devices LLC and customer and each Customer will not disclose such pricing and terms without the prior written consent form S.T.A.T. Medical Devices LLC; S.T.A.T. Medical Devices will have the right to share any Confidential information.
Unless specifically notified and agreed to in writing by S.T.A.T. Medical Devices LLC will not be bound by the terms of any government contracts to which Customer may be a party.
Waiver, Choice of Law and Venue.
The failure of either party to assert a right here under or to insist upon compliance with any term or condition will not constitute a waiver of that right or excuse any subsequent non-performance of any such term or condition by the other party. All transactions shall be governed by the laws of the State of New Jersey, excluding its conflict of law rules, and venue shall either be in the state courts in New Jersey or the federal courts for the Southern District of New Jersey.
Customer shall defend, indemnify and hold harmless S.T.A.T. Medical Devices LLC and its respective officers, directors, employees, subcontractors and agents (each individually, an “Indemnified Party”) from and against any and all claims, suits, liabilities, damages, settlements, charges, taxes and any other losses or expenses (including reasonable attorneys’ fees) (collectively “”Liabilities”) for physical injury to illness or death of , any third party regardless of status and damage to or destruction of any tangible property which the third party may sustain or incur, to the extent such Liabilities relate to the services; except for such Labilities relating to or arising out of a final judgment of gross negligence or willful misconduct of the Indemnified Party. In any action, suit or proceeding brought against an Indemnifies Party by reason of any such claim as specified above, customer shall resist and defend such action, suit or proceeding by counsel of its choice, at the sole expense of customer, provided that (i) the Indemnified Party notifies customer promptly in writing of the claim; (ii) customer’s counsel does not give rise to a conflict of interest with respect to the Indemnified Party; (iii) customer has the sole control of the defense and all related settlement negotiation by shall keep the Indemnified Party reasonably informed of status; and (iv) the Indemnified Party provides customer with all reasonably necessary assistance, information, and authority to perform the foregoing at customer’s expense.
Sales Tax and Duties, Import Fees.
S.T.A.T. Medical Devices LLC is required to charge federal, state, local tax, applicable duties, and import fees on products, or for providing a valid exemption certificate. Customer assumes responsibility for, and unconditionally guarantees payment or reimbursement of, all applicable taxes, fees, licenses, import duties, and expenses as may be applicable. When placing an order, customer shall indicate which products are tax exempt.
Limitation of Actions
No action, regardless of form, arising out of these terms and conditions may be commenced more than one (1) year after the cause of action has occurred, except and action for nonpayment.
